<p>The San Bernardino County Sun reported that a Fontana, CA man was arrested after an employee of the bank handling his foreclosed properties tripped over approximately $4.5 million worth of drugs. Apparently, he had enough business acumen to amass this much in illicit materials, but wasn&#8217;t clueing in that failure to pay the mortgage would bring people knocking on his door.</p>
<p>2. Do you feel compelled to clean your garage with fire?</p>
<p>Inman news reported in 2006 about a strange insurance case. It all started when a man was in his garage. He saw a strange wet spot on his garage floor.</p>

<p><strong>Mortgage Professional</strong> You need a mortgage professional who will be honest with you and work quickly for you.   Today&#8217;s mortgage market is different than it was one month ago, six months ago, a year ago.  Your mortgage professional must be up to date with the change in the market.  Many times the mortgage professional at larger lending institutions will be more capable of adjusting to this market and the changing needs of it.  I do not endorse any lender over another, but I do get financing from Wells Fargo and Countrywide, two of the nations largest mortgage lenders.</p>
<p><strong>Selling Realtor</strong> If you get the right buying realtor, they will not have time to sell your home. He will be too busy listing properties for the bank. You want to find a realator that will get you the most money in the shortest time. This is a business where if a house must sell quickly to make the maximum amount. You want a realtor who can get you the right price, too low you lost money on the sale too high the property will sit costing you interest and utility payments.</p>
<p><strong>Home Inspector</strong> Sounds simple enough, but if you don&#8217;t get this right it can cost you dearly.  Imagine buying a house without running radon tests or asbestos tests, only to find out months and tens of thousands of dollars later that you can&#8217;t sell because the beautifully remodeled home is contaminated. Some people walk into an investment property, see holes in the walls and ceilings, and get scared off.  I walk in, see those same holes, and know that for $400-$1,000 there are no more holes in the walls, the plumbing is repaired and I can move onto another phase of my renovation.</p>
<p><strong>Suppliers</strong> If you decide that you are going to make a living flipping houses, here&#8217;s a hint: Don&#8217;t buy retail!  Home improvement stores like Home Depot and Lowes charges 20-40% markups for nearly every product on their shelves.  To save money on supplies, you need to find a wholesaler and establish an account with them.. Typically you can find a wholesaler by Googling for it or in the phone book under Building Supplies &#8211; Wholesale.  To get an account, you need a company name, a credit card and a bank account, that&#8217;s it.</p>
<p><strong>Accountant</strong> Find one early, interview them and get their advice months ahead of time.  This will make the tax season a whole lot easier and less stressful. This is not where you want to save money with turbo tax. Make sure they are familiar with real estate investing. Also don&#8217;t wait till after the first of the year. sometimes you can make changes in Nov and Dec that will salve you thousands. Make sure they have degree in accounting, they don&#8217;t actually have to be a CPA.</p>
<p><strong>Attorney</strong> They can help you decide whether you should incorporate, form an LLC or go it alone as a sole proprietor.  A real estate attorney can save you money on title work, can draw up rental/ lease agreements and can advise you on tax strategy when buying and selling your real estate. If you buy a commercial building a real estate attorney is a must.</p>
<p><strong>Insurance Agent</strong> Like all other team members, it is key to find an agent that you know and trust to handle your real estate insurance needs.  You need to ask tough questions to your agent and consider what your exposure will be to loss from fire, flood, theft, or injured workers/ tenants.  If your policy leaves you exposed in any one of these major areas, your work could all be done for nothing.</p>
<p><strong>Friends &amp; Family</strong> Two of my favorite words. They will give you advice which is often good. If you feed them well, provide a frosty beverage or two, and don&#8217;t overwork them, the friends and family work crew will have fun, make your job more fun and most importantly work for free. Jobs like light demolition, painting, cleanup and many yard projects can be handled by anyone who owns a home.</p>

<p>Selling a property while the seller infrequently goes to settlement while assigning the agreement of sale to their buyer for a quick profit is know as flipping.  Wholesaling is rapidly selling a property &#8220;as is&#8221; with little or no fix-up.  Wholesaling can be a rewarding cash-profit business, but will it make you a dealer?  Some background is necessary before that question can be answered.</p>
<p>Being tagged as a dealer could be a financial disaster because, unlike an investor, you are subject to the highest ordinary income tax rates, plus Social Security taxes, other employment taxes and possibly alternative minimum taxes. Therefore, 50% or more of your hard earned profits could be drained by taxes.  Moreover, dealer profits (cash or paper) are immediately taxed in full and cannot be tax-deferred in any way including not being able to use a 1031 exchange, installment sale reporting, a self-directed IRA, certain trusts or any other tax deferral strategy.</p>
<p>If you demonstrate your status as an investor, you can be saved from the expensive pitfalls of being a dealer.  If not, you can be severely impacted by being tagged of being a dealer.  Its can be like being condemned to hades!</p>
<p>First off, just because you start to flip properties does not mean you are a dealer. Based on numerous tax courts cases (including a Supreme Court Case); actual IRS audits; and my extensive research; with planning, even a very large number of flips (in one year) could avoid costly dealer status.</p>
<p>Altogether, there are over 30 strategies to avoid the cost of a dealer. My experience indicates that one of the best strategies is investment intent. That is, demonstrate that the primary purpose of the quick sale profits is for investment purposes and not sales speculation. For example, the primary purpose (or purposes) of the quick sale profits can be for a number of investment necessities, such as down payment funds to acquire long-term investment keepers, or working capital for property investment operations including preventive maintenance.</p>
<p>There have been numerous cases and scenarios, some of which I have had first hand experience with, where a numerous number of sales in one year did not cause dealer status.   This is because of a very powerful defense against any IRS attacks with the principle that tax follows economics as opposed to sales speculation with tax avoidance motivation.  Consequently, as employed here, these flips are non-dealer, investment transactions with solid economic foundation, thus not a dealer activity.</p>
<p>Many entrepreneurs, who have literally sold hundreds of units in a short time, claiming not to be a dealer, have won their cases when challenged.  With the right planning and documentation you may do so also.  As of this writing, there has never been an issue of civil or criminal fraud with the issuance of investor over dealer classification.</p>
<p>The issue here is a very arbitrary question of fact and not of law. Accordingly, asserting any type of fraud (where the burden of proof shifts to the IRS) is very difficult and almost impossible. Therefore, real estate entrepreneurs have everything to gain and little (if any) to lose. They should do so by planning in advance with dealer-avoidance strategies (especially investment intent), avoid inept advisors, and go for it!</p>
